Have the beat available offline.
Write and create a song for personal use.
Make preliminary recordings to test your ideas.
If you wish to release your song as a single, include it in an EP/album, distribute it on streaming platforms like Spotify or Apple Music, or sell your music in any form, you must purchase a beat license. Licenses can be obtained via our website or selected marketplaces hosting our beats.
Restrictions:
You are not allowed to make any profit with free downloads.
Altering the beat or removing voice tags is prohibited.
Copying, distributing, or uploading beats or their components is strictly forbidden.
Violation of these rules may result in legal action for copyright infringement.
CREDIT AGREEMENT:
The licensee must credit the producer appropriately as follows:
Written media: “Prod. by Tofan Aslan” or “Beat by Tofan Aslan.”
Vocal credit (if applicable): Mention “Tofan Aslan” in performances.
Efforts must be made to ensure proper crediting, including on physical copies, digital platforms, and promotional materials. Failure to comply requires immediate correction.
ROYALTIES:
Publishing rights are split as follows (unless stated otherwise in the license agreement):

BEATS WITH HOOK(S):
Beats featuring pre-recorded vocals (“Hooks”) follow the same pricing and licensing terms as regular beats. However, credit to the featured singer is mandatory, e.g., “(feat. [Singer’s Name]).” Hooks are royalty-free, with the producer compensating the singer independently.
CUSTOM BEATS / REMIX PRODUCTION:
Custom beats and remix productions are treated like exclusive rights with these additional conditions:
Custom beats are created solely for the customer and will not be resold unless payment obligations are unmet.
An upfront payment of 50% is required, with the remainder due upon final approval.
Delivery includes untagged beat files and a license agreement within 24 business hours of final payment.
Licensor reserves the right to cancel custom projects with a refund, reverting rights as per payment level.
DRUM KITS / SOUNDS:
Products like drum kits and sound packs are royalty-free for use in productions but may not be resold, distributed, or extracted. Refunds are not offered for dissatisfaction, but demo files can be downloaded for evaluation.
MIXING & MASTERING SERVICES:
Full payment is required upfront.
Delivery timelines: 1-3 days for beats, 4-7 days for songs.
Customers must ensure audio files meet quality standards.
Errors in files may result in project cancellation with a refund.
By accessing or using services from Tofan Aslan, you agree to these terms. Non-compliance may result in legal action or termination of access to services.
Audio Samples
The Licensee is solely responsible for ensuring that any third-party samples they choose to include in their projects are properly cleared. When the instrumental is purchased, it is provided as a “Work Made for Hire,” meaning that all obligations related to clearing samples rest entirely with the Licensee. The Licensor is not liable for any misuse of sampled material incorporated with the licensed instrumental and does not claim ownership of any third-party sampled content.
YouTube Policy (Content ID)
The Licensor retains worldwide rights to register their compositions in Content ID systems, such as identifyy or AdRev, to manage and protect YouTube rights. These systems detect unauthorized usage of the instrumental and may issue temporary copyright claims, restricting monetization. However, claims do not lead to video takedowns or further penalties, allowing the content to remain viewable. The Licensee is strictly prohibited from registering the beat or song in any content identification system. This policy aims to prevent conflicts arising from multiple users licensing the same beat. Failure to comply may result in the termination of the license without compensation. Disputes on Content ID claims should include proof of purchase and be filed promptly within five days of receiving the claim.
MEMBERSHIPS
Memberships offer subscription-based licensing deals, charged monthly. These licenses are identical to those available for individual purchases, with a major advantage: you can select three beats for the price of one each month! Starting from your subscription date, you’ll gain access to three new beats with licenses included, as per your membership plan.
Memberships are managed via Beatstars.com, where you’ll create an account to access a private member area. Here, you can manage your subscription, licenses, downloads, and purchases. Beats and licenses obtained through your subscription remain permanent and accessible even if you cancel your membership. However, by canceling, you lose the ability to select new beats.
Tofan Aslan (Abdulkadir Sen) reserves the right to cancel any subscription at their discretion, with notification and explanation provided to active members. Paid monthly credits for beat selections remain valid. For clarity, reach out to us at info@tofanaslan before making a purchase. By subscribing, you agree to our license terms and conditions, as listed on our website. All purchases are final and non-refundable. If you wish to upgrade your membership or individual licenses, contact us for assistance.
PAYMENTS
We accept PayPal, major credit cards, Western Union, and bank transfers. Payments must be completed upfront before delivery. Pending payments will delay product delivery.
Payment plans can be arranged for services/products. These plans typically range from 2 to 6 installments, with at least 25% of the total price paid upfront. Failure to meet payment obligations results in forfeiture of previous payments due to administrative costs. Unpaid beats will be re-listed for sale but may remain under a WAW Lease if sufficient payments have been made.
If any payment is refunded or canceled, the associated contracts/licenses become invalid. Payments made under a plan will reserve the beat but do not grant exclusive rights until fully paid.
LICENSE UPGRADE
Non-exclusive license holders can upgrade their licenses to higher tiers by paying the price difference, even after the effective date of this agreement. This upgrade is available once per license.
DELIVERY
Beats are delivered as high-quality WAV and MP3 files, along with tracked-out stems. Products are emailed via automated systems or manually within 24 business hours for other purchase methods. Files are hosted through services like Dropbox or WeTransfer.
Physical copies (e.g., CDs or printed agreements) are available upon request, with delivery fees covered by the buyer. Check spam/junk folders for missing emails, and ensure pop-ups are enabled for downloads. Mobile devices may not support file downloads; use a desktop or laptop for best results.

GOVERNING LAW
This license is governed by the laws of the Licensor’s resident country (Mexico). Any disputes will adhere to Mexican law.
MISCELLANEOUS
Licenses are non-transferable and strictly tied to the composition specified. Previously sold licenses remain unaffected by future terms changes. Licensor reserves the right to use compositions for promotional purposes worldwide.
Exclusive rights license holders may transfer rights with written approval. Contact us for adjustments to current agreements.
GENERAL TERMS AND CONDITIONS
Licenses automatically become valid upon purchase. By making a payment, you confirm agreement to the terms listed on our website. Updates to terms will not affect previously sold licenses.
RESTRICTIONS
All sounds, instruments, and vocals remain the property of the Licensor or third parties. Audio content may not be used to create derivative products like instrumentals for sale, loop packs, or sample libraries. Beats cannot be uploaded or distributed without written consent.
Violations of these restrictions may result in the termination of commercial rights and the removal of content from third-party platforms. Contact us for clarification if needed.
WARRANTIES, REPRESENTATIONS, AND INDEMNIFICATION
Beats are provided “as is” without guarantees of suitability for specific purposes. Licensee agrees to indemnify the Licensor against any claims or damages arising from misuse or unauthorized use of the beats.
PRIVACY POLICY / DIGITAL DOWNLOAD POLICY / LIMITATION OF LIABILITY / TRADEMARKS AND COPYRIGHTS:
We are committed to protecting your privacy. Your personal information will never be shared with any third party outside of our business. We store your data securely on our encrypted servers, ensuring that all transactions and activities are handled through PayPal, Stripe, or banks using their highly secure platforms. Tofan Aslan (Abdulkadir Sen) does not access or store any of your financial details. Your privacy is guaranteed, and we will never request or store sensitive information. We are not liable for any damages caused by online security breaches or cyber-attacks.
All products available for purchase on this site are for digital download only. We do not ship physical items. Consequently, all sales of digital goods are final, and we cannot provide refunds for products that cannot be returned. In rare situations, such as duplicate purchases, we may offer a replacement with an item of equal or similar value. Each case will be reviewed individually based on its unique circumstances.
